PRIVACY STATEMENT

This privacy notice describes how FP DBS collects, uses and discloses personal data and what choices you have regarding your personal data.

When we refer to "FP DBS", we mean the company Ruys Handelsvereniging BV registered in the Netherlands (referred to herein as "we", "us" or "our"). 

We act as the controller or processor of your personal data, as explained in more detail in the "Applicability of this privacy notice" section below.

To the extent that information is associated with an identified or identifiable natural person and is protected as personal data under applicable data protection law, it is referred to as "personal data" in this privacy notice.

 

Applicability of this privacy notice

This privacy notice applies to all personal data collected or provided when you install or use the parcel tracking application "Parcel Shipping" (the "Application") and the services we provide in connection with this Application (the "Services"), and when you visit our website.

This privacy notice does not apply to third-party applications or software that integrate with the Services through our application ("Third Party Services"), or other third-party products, services or companies.


Access, provision and use of the Services may be governed by a separate agreement with our customers (the "Customer Agreement"), including the processing of personal data or other content submitted through the Application ("Customer Data").

A Customer is the organisation that has entered into the Customer Agreement with us. The Customer (for example, your employer) manages all associated Customer data and the operation of the Services. If you have any questions about specific Application settings and privacy practices, please contact the Customer. If you have received an invitation to participate in the Application but have not yet created an account ("Services Account"), you should seek assistance from the Customer who sent the invitation.

Data processing is a broad range of operations performed with Customer Data, including the collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, assembly or combination, restriction, erasure or destruction of data.

 

Personal data we process

We may process Customer Data and other information and data ("Other Information") in various ways:

- Customer Data. The Customer or individual granted access to the Application by a Customer ("Customer Authorised User") may provide Customer Data to us when using the Services. For example, the Customer or Customer Authorised User may provide through the Application name and contact details of the Customer Authorised User, package information (weight, dimensions, shipping ID, tracking number), carrier and consignee information (name, contact details), charges and fees, transaction and package delivery information.

- Other Information. We also collect, generate and receive Other Information:

(a) Application and Account information. To create or update a Services Account in our Application, you or the Customer (e.g. your employer) provide us with a name and an email address or similar account information. In addition, the Customer may provide us with billing information, such as Customer contact details, bank details and address.

(b) Communications Data. We may send you Services, technical and other communications or contact you to inform you about changes to our Services and important Services-related communications, such as security and fraud notices.

(c) Metadata about Services. When the Customer Authorised User interacts with the application and Services, metadata is generated that provides additional context about the Customer Authorised User's actions. For example, the types of Services used (if any);

(d) Log Data. Our servers automatically collect information when you visit or use our websites or Services and record it in log files. This log data may include the Internet Protocol (IP) address, the address of the web page visited before you used the website or Services, browser type and settings, browser configuration information and cookie information, the date and time the Services were used;

(e) Location data. We may receive information from your devices that helps us determine your approximate location. We may collect location data from devices in accordance with the consent process provided by your device and you may change this identifier in your device settings.

How we process personal data

In general, no one is required by law or contract to provide Customer Data or Other Information. However, certain personal data is collected automatically and if certain personal data is not provided, we may not be able to provide the Services.

 

Customer Data is used and processed by us in accordance with Customer's instructions, including any applicable terms in the Customer Agreement and Customer's use of the functionality of the Services. In relation to Customer Data, we are a processor and the Customer is the controller, who determines the purpose and means of processing Customer Data. For example, the Customer may grant and remove access to the Application, assign roles, access, share and modify Customer Data and otherwise apply its controls and policies to the Services.

We process Location Data only on the basis of consent from the Customer's Authorised User and you can change this identifier in your device settings.

We use Other Information to protect our legitimate interests in keeping our Services, website and business operating and to perform our Services to the Customer. More specifically, we use Other Information for the following purposes:

- To provide, maintain and protect our Services. This includes using Other Information to support the provision of the Services under a Customer Agreement, prevent or address service errors, security or technical issues, analyse and monitor usage.

- To communicate with you by responding to your requests, comments and questions. If you contact us, we may use your Other Information to respond.

- For billing, account management and other administrative matters. We may need to contact you for billing purposes and use Application and Account Information to manage accounts and track billing and payments.

- To investigate and help prevent security problems and abuse.

 

How we share and disclose information

Customers determine their own policies and practices for sharing and disclosing Customer Data. We do not determine how Customers choose to share or disclose Customer Data. We may share and disclose Customer Data in accordance with a Customer's instructions and with appropriate consent in accordance with the terms of the Agreement with the Customer and the Customer's use of the functionality of the Services.

When the Customer's Authorised User submits personal data in the Application, it may be displayed to other authorised Users in the Application. For example, the Authorised User's name and email address may be displayed with their profile. Representatives of the Customer (administrators) and Authorised Users of the Customer may access, modify or restrict Customer Data.

We may engage third parties as service providers or business partners to process personal data and support our business. For example, these third parties may provide storage services. We may also share personal data with our affiliates, parent companies and/or subsidiaries. We take the necessary measures to ensure that the said companies process personal data according to the required and adequate security measures and otherwise in accordance with data protection legislation and best practices.

We may disclose customer data or other information if we reasonably believe it is consistent with our legitimate interest or required by applicable law, regulation or legal process. We may disclose customer data or other information to protect and defend the rights, property, our users or third parties, or in connection with the investigation and prevention of illegal activity, fraud or security issues, including the prevention of harm.

We will not disclose more personal data than necessary for the purpose of disclosure and in compliance with regulatory and data protection laws.

We do not transfer personal data outside the European Union and European Economic Area countries.

 

Retention of data

We retain personal data only for as long as necessary for the purposes set out in this privacy notice or as required by regulatory or data protection legislation.

We will retain Customer Data in accordance with a Customer's instructions, including any applicable terms in the Customer Agreement and the Customer's use of the functionality of the Services.

We may retain Other Data for as long as necessary for the purposes described in this privacy notice. This may include retaining your Other Data after you deactivate your Services Account for the period necessary to pursue legitimate business interests, comply with legal obligations, resolve disputes and enforce our agreements.

 

Your rights

You have certain legal rights regarding the processing of your personal data. Subject to legal exceptions, you have the right to request access to information and to update, delete or correct such information. You can usually do this through the settings in your Services Account. If you cannot use the settings, please contact the Customer for additional access and assistance.

You have the right to file complaints about the use of personal data with the Netherlands Privacy Protection Authority (https://www.autoriteitpersoonsgegevens.nl/nl/zelf-doen/gebruik-uw-privacyrechten/klacht-melden-bij-de-ap) if you feel that the processing of your data infringes your rights and interests.

 

Changes to this privacy statement

We may change this privacy notice from time to time. Laws, regulations and industry standards evolve, so these changes may be necessary, or we may make changes to our services. We will post changes on this page and encourage you to read our privacy notice to stay informed. If we make changes that materially affect your privacy rights, we will notify you additionally, for example via email or through the Application. If you disagree with the changes in this privacy notice, you should deactivate your Services Account. contact the Customer if you wish to request deletion of personal data under their control.
